These Terms of Use (or "Terms") govern your use of听Yareta听(丑别谤别颈苍补蹿迟别谤听the "Portal" or 鈥Yareta鈥), except听in the case we would听expressly state that separate terms (and not these) apply, and provide information about听Yareta, outlined below. When you create a听Yareta听account or use听Yareta, you agree to these Terms.听听

Data Protection Policy听
As听Yareta听is a product of the 玉美人传媒 (hereafter UNIGE), the听听is applicable to听the听YaretaPortal.听听
听
In order to use the听Yareta听Portal, we require you to consent to the collection and processing of your personal data before you start using the services. If you do not agree with the terms of the Data Protection Policy, you may not create an account on the听Yareta听Portal.听听
听
Access to content on the听Yareta听Portal is open to all.听

Scope of application, applicable law, acceptance of conditions and definitions听
Yareta听is听a听service,听composed听of a modular infrastructure and the听necessary听procedures for the operationalization of a solution for the听management, preservation and publication of research data, adapted to both researchers and institutions, supporting most of the tools and formats used in all scientific disciplines and in complete security.听
听
The services provided by听Yareta听comply with the听Law on Public Information, Access to听Documents, and Protection of Personal Data(LIPAD)and the听Code of Obligations听(CO).听听Only Swiss law is applicable.
听
UNIGE听provides the听Yareta听Portal听on the basis of听these Terms.听听
UNIGE听reserves the right to change these听Terms听any time by publishing the updated version without prior notice.听In this event,听partner institutions and users听(hereinafter 鈥渄epositors鈥)听will be asked to accept the new Terms. Any substantial changes will be clearly indicated.听

The use of听Yareta听is subject to听the听acceptance of these Terms.听听

Without express acceptance of the Terms, you will not be able to use听Yareta.听

Content听

Scope: All fields of research. All types of research artifacts.听Content must not violate privacy or copyright, or breach confidentiality or non-disclosure agreements for data collected from human subjects.听

Eligibility of听research data:听Research data听from any stage of the research听data听lifecycle听is accepted.听

Eligible depositors: Anyone registered with听SWITCHaai听or SWITCH听edu-ID听account linked to Geneva higher education institution (including the听Geneva 玉美人传媒 Hospitals,听HUG)听may create an organizational unit to deposit data. Registered users are allowed to deposit听content for which they possess the appropriate rights.听

Ownership: By uploading content,听no change of ownership is听implied,听and no property rights are transferred to鈥Yareta. All uploaded content remains the property of the users prior to submission.听

Data file formats: All听file听formats are allowed听鈥听even听those that are not suitable for听preservation. A听compliance听system (in听the form of stars)听allows听鈥渦nfriendly formats鈥 to be distinguished from 鈥済olden formats鈥.听

Volume and size limitations:听There is no technical limit to the amount of data you may deposit.听Any limit听depends solely on the听pricing.听

Metadata types and sources: All metadata are stored internally in XML-format. Metadata are exported according to the听.听

Language: For textual items, all languages are听accepted.听

Licenses: Users must specify a license for all publicly available files.听Licenses for closed access files may be specified in the听Metadata form.听

Access and Reuse听

Access to data objects: Files may be deposited听in听closed, restricted,听or听openaccess听(with听the听possibility of听embargoes听as explained听further down). Files deposited under closed access are protected against unauthorized access at all levels. Access to metadata and data files is provided over standard protocols such as HTTPS听and听.听

Use and re-use of data objects: Use and re-use are subject to the license听chosen by the user听under which the data objects were deposited.听

Embargo status: Users may deposit content under an embargo status and provide an end date for the embargo. The repository will restrict access to the data until the end of the embargo period; at which time, the content will听automatically听become publicly听available.听

Restricted Access: Users may deposit restricted files with the ability to share access with others if certain requirements听鈥 chosen by user 鈥听are met. These files will not be made publicly available,听and sharing will only be made possible by听the听original file approval听depositor.听

Metadata access and reuse: Metadata are licensed under听. All metadata are exported via听听and can be harvested.听

Removal听

Withdrawal: If the uploaded research object must later be withdrawn,听Yareta听will indicate听the reason for this听withdrawal on a tombstone page, which will henceforth be served in its place. Withdrawal is considered an exceptional action, which normally should be requested and fully justified by the original听depositor. In any other circumstance reasonable attempts will be made to contact the original听depositor听to obtain consent. The听听and the URL of the original object are retained.听

Longevity听

Versions:听Metadata听are versioned听but not听Data files.听The uploaded听Data filesare听archived as a Submission Information Package. Derivatives of听Data files are generated, but original听Data files are听never modified.听Archives听can be retracted from public view; however, the data files and听Metadata听are preserved.听

Replicas: All data files are stored听in听the听UNIGE data centers in Geneva, Switzerland. Datasets are kept in two replicas on redundant architectures.听

Retention period: Items will be retained for the lifetime indicated upon deposit.听

Functional preservation:鈥UNIGE听makes no promises of usability and understandability of deposited objects over听time but听recommends听鈥済olden formats鈥 to increase functional preservation on the very long term.听

Fixity and authenticity: All听Data files are stored along with a checksum (small-sized block of dataderived from听the听datasets听for the purpose of detecting errors that may have been introduced during听their听transmission or storage);听different checksum formats are used. File听checksums听are regularly checked to听ensure听that听the corresponding datasetsremainintact.听

Obligations,听Responsibility and听Jurisdiction听
Depositors听are to ensure that research data management requirements from ethical, statutory, academic, funding and publishing bodies are observed, including appropriate handling of personal and confidential data, as stipulated by the听LIPAD,听the Federal Act on Research involving Human Beings (HRA)听or any of the laws applicable to their deposited Data files.鈥听

UNIGE听declines all responsibility for the content posted on the听Yareta听platform by its听depositors.听It is emphasized that depositors remain responsible for the content of the archives and collections they create on听Yareta.听Depositors may be asked to make necessary changes and/or additions to their Data files and Metadata in order to comply with these Terms. In case of non-compliance, UNIGE may take certain measures and draw consequences at the discretion of the UNIGE听Yareta听team.听

UNIGE听reserves the right to migrate, curate, move, etc.,听the听deposited data听in order听to听guarantee听continued access to its archives in the event of cessation of operations.听
听
UNIGE听is solely responsible for the services and obligations arising from the contractual relationship between听UNIGE听and听depositors.听
听
By accepting the Terms, you expressly agree to听the jurisdiction of the Geneva Courts听and听Swiss Federal Supreme听Court.听
